The court accepted the orthopedic expert's opinion that the applicant suffers a 3% permanent loss of earning capacity, applied sections 9, 10 and 10A of the Employees' Compensation Ordinance to compute statutory compensation, excluded overseas medical expenses, deducted prior payments of HK$12,800, and awarded a total of HK$107,275 plus interest and costs accordingly.
