The court held that the executrix was entitled to have her costs in the administration action borne by the estate only for the period up to and including filing a limited affirmation (and only half the costs of that affirmation) because her initial investigation and response were reasonably arguable; however, by advancing a position favourable to a class of beneficiaries and compromising neutrality she lost entitlement to broader estate indemnity and must personally bear her Beddoe application costs and the costs of P and S in the Beddoe application.
