RHC Order 85, rule 2 covers the dispute; on the evidence there were no particulars or contemporaneous communications establishing an express trust and the WhatsApp messages and account entries supported at most a custodial arrangement. Consequently the alleged trust did not exist and mother was entitled to an interim distribution of HK$5,000,000, which the defendant was ordered to pay by the specified date, without prejudice to further distribution at the adjourned hearing.
