On the balance of probabilities the stolen van bearing false plates found in the first defendant's possession was the vehicle that struck the plaintiff and the first defendant was the driver; the driver breached the duty of care by failing to give sufficient clearance and to slow or warn, attracting 75% liability, with the plaintiff 25% contributorily negligent; accordingly judgment entered for the plaintiff for assessed damages reduced by 25% with interest and costs.
