The Court of Appeal held that the deputy judge erred in allowing DL to intervene and set aside the probate judgment because the Notice of the 2012 Action was validly served on DL's solicitors, DL failed to acknowledge service and then delayed unreasonably; the 2012 probate judgment was binding on DL and the application to extend time and to set aside the judgment must be refused. The appeal by LKT was allowed, the deputy judge's order set aside, and the summons dismissed.
