The defendants' summons was dismissed because they provided no satisfactory explanation for delay in seeking variation within the 14-day period and their core substantive ground — that the claim was within the District Court's jurisdiction at all times — was incorrect since the plaintiff's claim sought HK$1,799,514 and therefore was not within District Court jurisdiction before 3 December 2018; accordingly the costs order nisi as made in the Judgment is not varied, the extension of time is refused, and costs of the summons follow the event and are summarily assessed at HK$40,000.
