The plaintiff established continuous exclusive possession from 1976, ceased paying rent in 1991 and demonstrated intention to possess since late 1993 by paying rates, utilities and management fees, changing records to his name and supplying corroborative receipts and affirmations; these facts satisfy adverse possession requirements and Limitation Ordinance provisions so the defendant's title is extinguished under s17 and a declaration vesting possessory title in the plaintiff is warranted despite the absence of trial or defence.
