Master breached the agreement by failing to make Graver III available within the implied timeframe necessary to perform clause 3 and by dealing directly with EJDS in breach of clause 9; that breach entitled Tunlees to terminate and recover the deposit and proven expenses, but Tunlees failed to prove claimed loss of profits so those heads were denied.
