Leave to appeal was refused: the institutional attack on the IDT was unarguable given statutory safeguards and appellate remedy; Shek Mei Ling remains correct on profit assessment; the late constitutional point was properly refused; the disqualification order validly need not list every company.

The application for extension of time was dismissed because there was an unexplained delay of nearly 12 months, the applicant failed to show a reasonable prospect of success on appeal as the previously undisclosed PSC Advice (admitted as new evidence) confirmed that the disclosed materials (M5) accurately reflected the Advice so no prejudice arose from non‑disclosure, and permitting an appeal and rehearing in these circumstances would be unjustified and contrary to good administration.

Article 10 of the Bill of Rights applies to police disciplinary proceedings that determine civil rights and obligations; Regulations 9(11) and 9(12) which impose a blanket ban on professional legal representation are inconsistent with Article 10 and unconstitutional; impairment of operational efficiency is an essential element of the offence under PGO 6-01(8) and the prosecution bears the burden of proof; because the tribunal failed to consider permitting legal representation the appellant was denied a fair hearing and the convictions and sentences are quashed.
