Because the Crown accepted there was no false arrest fabricated against an innocent person and the officers genuinely suspected the suspect, the sentencing judge's starting point (21–24 months) overstated seriousness; the sentences were therefore excessive and were reduced so as to permit the applicants' immediate release in the special circumstances of the case.
