The appeal is dismissed because the magistrate applied established sentencing starting points and properly reduced sentences for guilty pleas, the partly consecutive structure was justified given distinct and repeated offences so the totality of 18 months and six weeks imprisonment was not excessive, and the suspended sentence was correctly activated and ordered consecutive under section 109C absent special circumstances.

The magistrate applied accepted sentencing starting points for false two-way permit offences, discounted sentences for guilty pleas, applied the totality principle by notionally aggregating matters and giving credit for the 10 months previously served; the Court found no error in that reasoning and dismissed the appeal, thereby confirming the imposed sentences and the manner in which they were ordered to run (concurrent on Charges 1–3, part consecutive on Charge 4).

For making false representations to immigration officers where no forged travel document is involved (notably where the accused held valid travel documents and was a foreign domestic helper), the appropriate starting point is 6 months and an appropriate sentence after plea is 4 months; the magistrate erred in adopting a higher starting point derived from forged‑document authorities but, applying totality, the effective sentence is adjusted by substituting concurrent and consecutive terms to produce an 8‑month total.

The offences of overstaying and deliberate false representation to immigration officers are serious and deserving of imprisonment; the magistrate's sentence structure (2 months for overstaying and 6 months for each false representation, concurrent between the two misrepresentations and consecutive to the overstaying sentence, total 8 months) was within proper sentencing bounds and the alleged family circumstances did not justify interference with the sentence.
