The Court upheld the sentences because the driver was aware or ought to have been aware of fatigue, continued driving thereby becoming effectively unconscious and causing death and serious injury to multiple persons; that conduct is a serious aggravation warranting deterrent custodial sentences and the trial judge's concurrent sentences were appropriate and not excessive.
