The statutory scheme requires the court to assess overall fitness under s168H with regard to the matters in the Fifteenth Schedule; there is no bar to making a disqualification order in respect of conduct or offences committed before the disqualification provisions came into effect, and continuing offences may be relied upon until cured; timing may affect discretionary penalty but does not negate unfitness.
