On a full re‑hearing of the evidence the court agreed with the trial judge's detailed credibility findings, concluded the prosecution proved the offence of fighting in a public place beyond reasonable doubt, rejected the appellant's self‑defence claim as unreasonable and retaliatory, and therefore dismissed the appeal and upheld the conviction.

The appellate court upheld the conviction because contemporaneous CCTV and the driver's consistent testimony established that the appellant initiated the physical attack; the prosecution disproved lawful self-defence beyond reasonable doubt; the trial was procedurally fair and the trial judge's credibility findings were justified.

The High Court dismissed the appeal: the trial magistrate properly considered and rejected self‑defence after detailed analysis of the objective video; the appellant's deliberate repeated poking directed at the complainant's face constituted an intentional use of force which, combined with the complainant's responsive assault, amounted to an unlawful 'fight' within s25 of the Public Order Ordinance; the incident occurred in a public place and the taxi at the scene formed part of that public place; accordingly the conviction and fine were safe and affirmed.

Because the magistrate omitted to consider self-defence, a defence properly raised on the evidence, the conviction was unsafe and must be quashed as the Crown had the burden to disprove self-defence and the evidence did not clearly do so.
