Because the issues of illegality and unenforceability claimed in the High Court actions have no independent existence separate from the competition defence before the Tribunal, all liability issues must be tried together with the Competition Tribunal proceedings; there is no basis to split trial on liability and quantum given pleadings do not disclose a valid set-off or defence dependent on a future cause of action.
