The trial judge accepted the police officer's credible testimony and the video evidence which showed no officer gesture before the taxi crossed the continuous double white line; the appellate court independently re-examined the evidence (including video) and concluded beyond reasonable doubt that the appellant's explanation was not credible or reasonable, so the conviction was safe and must be upheld.
