The court will continue the ex parte injunction temporarily until determination of the applicant's summons (or further order) where public health concerns exist but the respondent has not filed opposing evidence, provided the applicant gives clear undertakings to comply with the regulating instrument (regulation 30AA), to pay all rents and monies that would become due, and to prosecute the appeal expeditiously; damages alone are inadequate where possession would render the appeal or review nugatory.
