The judge, sitting alone, had the Turnbull guidelines in mind and the evidence showed the constables had a clear face-to-face view at about two meters, gave accurate clothing and physical descriptions, and made a prompt identification at parade; forensic evidence only showed inflammable liquid with components similar to kerosene and was not sufficiently adverse to undermine the identification; accordingly the conviction was safe and leave to appeal was refused.
