On the evidence the court found that all material terms were agreed via WhatsApp and that the 1st Defendant induced the Plaintiff to deal with her (describing the Singapore company as her company) and therefore was a contracting party; the 1st Defendant repudiatorily breached by non-delivery of Penfolds Bin 407 Wines and is liable to refund AUD259,600 and consequential damages of AUD16,450 and HK$200,000; claims against the 2nd Defendant dismissed.
