The court refused the stay and dismissed the 2nd defendant's applications to discharge the prohibition order because the plaintiff established a good cause of action in fraud (misrepresentations made and acted upon in Hong Kong), the 2nd defendant was shown to be likely to leave Hong Kong and enforcement would be obstructed, and the 2nd defendant failed to show the BVI was clearly and distinctly a more appropriate forum or that he had a substantial defence; accordingly the prohibition order was correctly granted and its extension was justified.
