Section 32(2)(b) of the District Court Ordinance requires deduction of employees compensation actually paid when assessing the value of a plaintiff's claim at commencement; applying the objective test from Lai Ki/Hopkins, it was not obvious to a reasonable plaintiff or adviser that the claim would be within the District Court limit after deduction of the periodical payment, therefore the plaintiff's costs were properly taxed on the High Court scale and the appeal is dismissed.
