Breach of the tender provisions in the Code of Practice did not automatically invalidate the Owners Incorporated's decision to award the renovation contract where a comfortable majority of members gave written consent; s44(2) makes breach evidential only, and the Foss v. Harbottle principle applies to owners incorporated, curing the procedural defect; accordingly no order was made against the respondent.
