The application to set aside the Chief Judge's security for costs order was refused because the appellant was effectively impecunious and the substantive appeals had virtually no prospect of success as they sought to relitigate issues finally decided (res judicata) and the settlement/waiver was valid and supported by consideration, so security of HK$165,000 was a proper exercise of discretion.
