The Defence was plainly frivolous and incapable of success: an alleged breach of s7(1)(b) MLO in signing outside licensed premises does not in itself render the loan unenforceable, and alleged fraud by a third party not involving the lender or its agent does not afford a defence to the lender; accordingly the Defence is struck out and judgment entered for principal and contractual interest with an order nisi for possession subject to prior mortgagees' rights.
