The Court found on the evidence that a Funding Agreement existed and that BC, Ko and Dignity received the 1st and 2nd Sums as trust property for the Plaintiff, assumed control and fiduciary duties in respect of those funds, and by representing the funds as their own and failing to account they breached trust and fiduciary duties; accordingly they are liable to account and repay; there was insufficient evidence to find KIL, Wife and Sister liable for unlawful means conspiracy.
