The court held that sedition offences qualify as offences endangering national security under the NSL and, because the NSL prevails over inconsistent local law (Art 62) and contemplates handling such cases in Hong Kong courts (Art 45), the local restrictions in the Second Schedule to the Magistrates Ordinance must be adapted so as not to prevent lawful transfers; accordingly the transfer of the sedition charges to the District Court was valid and the District Court has jurisdiction to try them.
