The court adopted the procedure in Rong Wei v Chiu Sung Fai and adjourned the Amended Summons to be heard substantively together with the Originating Summons in HCMP 176/2026 so that both matters can be dealt with together and all interested parties can make submissions; costs reserved.

The court declared that the US$51,652.44 in the defendant's account was held on constructive trust in favour of the 1st plaintiff because the funds were obtained by email fraud and the 1st plaintiff provided the funds, but refused to order the bank to release the funds because the bank was not a party or notified, there was no garnishee application, and unknown subsequent transactions and potential third party rights or bank set-off required the bank and any affected parties to be heard before any transfer order could be made.
