The Court of Appeal allowed the appeal because the judge's finding of effective inter vivos gifts of the company account balances was unsupportable on the evidence: there were no clear words of gift, no effective delivery, and transfers/signatory arrangements and signed blank papers did not constitute completion of gift; gifts of future balances lacked consideration; accordingly KS had not divested himself of the assets and his will's bequest to his children must stand.
