On the admissible material the judge was tentatively satisfied that the plaintiff probably handed the gems to the 4th defendant and that some agreement affecting the gems was made in Hong Kong; accordingly the plaintiff had satisfied the requirements of Order 11 r.1 on a good arguable case basis and the ex parte leave to serve out was properly left standing; the Registrar's refusal to set aside the order was affirmed and the appeal dismissed.
