The court found plaintiff had established a serious question to be tried and that the balance of convenience favoured an interlocutory injunction to recover possession of the 500 sq.m. workshop because of the contractual requirement to perform emergency works and lack of alternative premises; however, the court refused to order delivery up of unused Government Goods because defendants had sworn they had delivered all unused items and plaintiff produced no contrary evidence.
