The offence of conspiracy to defraud is not limited to agreements intended only to cause economic loss; intention to practise a fraud or to act to the prejudice of another's right suffices. Falsely creating the appearance of competitive quotations in breach of procurement practice can amount to conspiracy to defraud. The trial judge erred in requiring evidence of economic loss and in concluding the quotations could not be read as representations of genuine competition.
