On a straight bill of lading a carrier who releases goods without production of the original bill is liable for breach of contract and conversion; the shipper's negotiation with consignee did not constitute consent to the wrongful release; the Hamburg Rules do not operate to extinguish the carrier's obligation in these circumstances; AL failed to discharge the evidential burden to show goods were defective; therefore summary judgment for plaintiff for the claimed sum was appropriate.
