The trial judge's finding that the signatures were authentic and the transfers genuine was supported by evidence and by his assessment of witness credibility; the appellate court will not overturn such findings absent absence of evidence or incontrovertible contrary documentary proof; therefore the appeal is dismissed.

On the balance of probabilities the guarantee was not signed by the defendant; the judge preferred the expert handwriting analysis (centralisation characteristic and document coincidences) and found both parties' credibility issues but concluded the totality of documentary and expert evidence outweighed the plaintiff's assertion of execution, therefore dismissing the claim.

On the balance of probabilities the court accepted the defendant’s and corroborating witnesses’ evidence and found the May 10, 1966 will was genuinely signed by the deceased and witnessed in the presence of the two named witnesses; accordingly the 1966 will revoked the 1961 will and probate of the 1966 will was granted.
