It was proper for prosecuting counsel to cross-examine the defence handwriting expert about limitations, methodology and subjective elements of his opinion even though the prosecution's own expert had reached a similarly qualified view but was not called; that cross-examination was within permissible bounds, not unfair, and did not render the trial or conviction unsafe. The appeal was dismissed.

The plaintiff failed to prove on cogent evidence that the 2002 and 2003 tenancy agreements or the signatures therein were forged; absent proof of forgery the tenancies stood and defeated any animus possidendi required for adverse possession, so the adverse possession claim failed and the plaintiff must give possession of the Disputed Area to the 3rd defendant.

The summons for leave to adduce fresh handwriting expert evidence on signatures of living parties was dismissed because the applicant failed to show sufficient cause to vary prior orders limiting expert evidence to the deceased father's signatures; allowing the application would be unjust, prejudicial, and contrary to consolidation, procedural economy and Civil Justice Reform objectives, particularly where witnesses are available for cross-examination and there has been no change in circumstances or appeal against the prior orders.
