The court found plaintiffs established valid, enforceable loan agreements and legal charges; defendants' principal defences (undue influence, unconscionability, economic duress, forgery and MLO non-compliance) failed due to lack of credible evidence, contemporaneous documentation, and witness findings; accordingly plaintiffs were entitled to possession of charged properties and monetary judgments as ordered.
