The EC Consent Judgment admitted liability based on a single accident on 24 January 2014 and, read with the EC pleadings and statutory framework, that factual issue was necessarily decided; permitting the Contested Sentence asserting cumulative repetitive trauma would relitigate that decided issue and amount to abuse under the Henderson principles; accordingly leave to amend to include the Contested Sentence is refused and the relevant parts of the Master's Order are set aside.
