The court held that s.2 of the High Court Ordinance cannot be used to treat every person served under an unusually wide substituted service order as a party where the context requires application of specific joinder rules (O.15 rr.4 & 6); substituted service in these circumstances did not create a new category of party, Ms Chow did not apply for joinder and therefore was not a party and her summons is dismissed.
