The Variation Summons was dismissed because the Relevant Plaintiffs were partially successful in confining and limiting the Liquidators’ orders, the plaintiffs’ conduct was not shown to be unreasonable to a high degree, the Liquidators had relied on improper statutory bases (notably s197 and inappropriately advancing s286B), and therefore indemnity costs were not justified; the Costs Order Nisi stands and the Liquidators must pay the Relevant Plaintiffs’ costs of the Variation Summons, to be assessed on a gross sum basis with a timetable for filing costs and objections.
