The court found on the evidence that the 1st Defendants operated websites and communications offering regulated activities while unlicensed and unregistered, thereby breaching ss109 and 114; the named corporate account holders opened and received victim remittances and were therefore held to have aided, abetted or been knowingly involved in the contraventions; accordingly, s213 declarations and discretionary orders (injunctions, asset restraints, pro rata restitution to victims and appointment of an administrator) were desirable and would not unfairly prejudice any person, and were granted.
