In a contract between Hong Kong parties the reference to 'the International Arbitration Centre' in Clause 24(b) is to be construed as a reference to the Hong Kong International Arbitration Centre; the correct procedure is for the claimant to apply to HKIAC to appoint and, if HKIAC declines, for the claimant to apply to the court under Article 11 of the Model Law; the court will not make the declaration sought in the originating summons and accordingly made no order on that summons.
