The Court held that the composite judgment (2019 finding and 2020 sentence) constituted an appealable order under DCO/High Court Ordinance and did not require leave; fresh evidence explaining delay caused by the respondents' solicitor was admitted as necessary in the interests of justice; on that evidence the prosecution failed to prove beyond reasonable doubt the requisite mens rea for contempt because the failures were unintentional and caused by the solicitor’s dereliction, therefore the contempt findings and sentence were set aside.
