The court refused the prosecution's costs application. It held that the defendants' challenges to expert qualifications, to the attribution of the designation 'DR' to D1, and to the relevance and limited admissibility of GMP evidence were legitimate, reasonably pursued and limited in scope; the prosecution did not establish that those challenges were unjustifiable or caused unnecessary additional expenditure warranting a costs order under the CCCO.
