The magistrate was entitled to accept PW1 and PW2 as honest and reliable; their evidence established an irresistible inference that the appellant took employment in breach of s38AA, therefore the conviction and the imposed sentence are not unsafe or excessive.

The convictions of D3, D4 and D6 on the 3rd charge were unsafe and quashed because the conviction depended on partisan inmate testimony that was inconsistent with and not supported by independent CSD officers and CCTV; conversely, the additional 10-month consecutive sentences on D1 and D2 were appropriate and not manifestly excessive given the savage nature of the attack in a maximum security prison and the public interest in deterrence.

On the evidence as a whole the essential elements of attempted robbery were not established prima facie; although voice and actions can constitute a threat, the prosecution had not proved beyond a prima facie threshold that the defendant's conduct amounted to attempted robbery, therefore the conviction was quashed and the sentence set aside.
