The magistrate correctly admitted the photograph because in extradition committal proceedings he must accept and consider legally admissible evidence and has no discretion to exclude relevant evidence because it may be prejudicial; exclusion for prejudice is a matter for the trial judge, and on the material a reasonable magistrate was entitled to commit.
