The Court held the trial judge correctly found the prosecution proved identification and assault beyond reasonable doubt: Turnbull did not apply as identification depended on continuity of sight and proximity rather than a fleeting facial identification; the judge reasonably preferred consistent police testimony supported by video snapshots and medical reports; there was no evidential basis for lawful self-defence given available evidence and the appellant's failure to testify; conviction was therefore safe.
