The appeal was allowed because the learned Magistrate's summary dismissal of the defence witness Lau Chi without critical analysis of his account, and without juxtaposing it with the Inspector's evidence or considering possible exaggeration, was a fatal flaw that undermined the safety of the conviction for assaulting a police officer.

Identification was sufficient where a Senior Inspector produced a warrant card and confirmed the Sergeant as a police officer; the Sergeant's subjective suspicion under section 54 lawfully authorized the stop and proposed search; the appellant consented to a station search so lack of an express statement of reason did not render police conduct unlawful; a limited frisk for weapons for safety prior to transit was lawful and not merely a blind compliance with orders; consequently the conviction for obstruction (elbowing during the frisk) was supported and the appeal was dismissed.
