    The appeal was allowed because the court could not exclude the possibility that DW1's evidence (that the biting dog was a black mongrel, not the appellant's German shepherd) was true, and even if DW1 were excluded the evidence did not establish that the biting dog was the appellant's dog beyond reasonable doubt; therefore the conviction was unsafe and quashed. Despite allowing the appeal, the court exercised its discretion to refuse the appellant's costs application given the circumstances and the unmeritorious nature of most grounds pursued.
