The two month imprisonment suspended for twelve months was manifestly inadequate for an offence attempting to pervert the course of public justice; the magistrate erred in understating the maximum penalty and failed to impose an immediate custodial sentence appropriate to the public interest, and therefore the Court of Appeal set aside the sentence and imposed nine months' immediate imprisonment.
