An Immigration Tribunal that functions as a fully judicial body and decides vital residential or liberty rights must, as a matter of fairness, provide outline reasons showing the issues addressed and the evidence relied upon; however, the Tribunal's reasons in these two cases were adequate to satisfy that duty, and the presence of the Tribunal's legal adviser during deliberations (permitted by s53G(2)) did not invalidate the determinations; Mayo J's order quashing the decisions was therefore set aside and the Tribunal determinations restored.
