On construction the March 10, 1988 immunity required the plaintiff, when requested by the ICAC, to attend and give viva voce evidence at the trial of Chan including any retrial; the plaintiff failed to comply by refusing to return for a retrial, thereby repudiating the agreement, and the ICAC-plaintiff confidentiality did not bind the defendant, so the defendant was entitled to institute disciplinary proceedings and use the statements; consequently the plaintiff's declarations and relief were refused.
